Removal of Conditional Resident Status
A conditional resident card is issued for 2 years to foreign nationals who obtain status through marriage to a U.S. Citizen before their second wedding anniversary. In order to obtain permanent resident status, a conditional permanent resident must file a petition to remove the condition during the 90 days before the card expires.
The process to remove the conditional resident status gives Immigration a second opportunity to review the validity of the marriage. There are certain exceptions to the requirement that the petition be jointly filed.
